EU makes progress on bank capital, curbing bonuses

LONDON (Reuters) - European officials have reached tentative deals to implement tougher capital rules for banks in January 2014 and to cap bankers' bonuses, inching them towards agreement on a new law to strengthen the financial system.

European Union (EU) states and the European Parliament met in Strasbourg, France, and despite progress on such key issues failed to agree an overall deal on a law to implement so-called Basel III rules, which require banks to hold more capital.

A spokeswoman for the parliament said there would be a further meeting on Tuesday to iron out remaining issues.

The Basel III rules are part of a drive by regulators across the world to prevent a repeat of the 2007-09 financial crisis. They would force the EU's 8,000 banks to triple the amount of capital they hold compared with before the crisis, in the hope that would make them strong enough to cope with market shocks without the need for a repeat of taxpayer-funded rescues.

World leaders agreed in 2010 that Basel III should be phased in over six years from January, but that deadline is already unfeasible in both Europe and the United States as banks and governments squabble over the details.

The delay in implementing Basel III means banks and investors are left in the dark for longer about the exact impact of new rules on future profitability as the EU law will diverge in some respects from the global Basel accord.

The EU negotiations on Thursday tentatively settled on a January 2014 start, a parliamentary source said.

The EU's 27 states were represented by the bloc's president, Cyprus, and the elements agreed at the meeting could still be thrown out by member states next week. The parliament aims to vote on a final deal in February.

One key hurdle to a deal has been parliament's insistence that a bonus should be no more than a banker's salary. But lawmakers gave some ground on Thursday.

Bonuses would still be no more than the salary but, with shareholder approval, could go up to twice that level, a second parliamentary source said.

The deal on bonuses came after parliament agreed to member states' insistence on implementing other elements of the Basel accord - a balance sheet cap and long-term liquidity buffer - through new legislation rather than delegating the task to the European Commission.

Separately, the global Basel Committee, which wrote Basel III, is meeting to discuss easing its planned liquidity buffer as economic conditions remain tough.

It is not clear if the committee will issue a statement on Friday or wait until its conclusions have been signed off by its oversight body which is expected to meet next month.

Marijuana sales? Lots of legal, policy obstacles still to weed out in ...

Washington State's new law makes it legal for adults to possess up to an ounce of marijuana, but some speculate the federal government will prosecute those who use marijuana on federal land because federal law prohibits marijuana use. NBC's Kristen Dahlgren reports.

Washington and Colorado say you can legally smoke marijuana for fun now, but here's the catch: You can't legally buy it.

Voters in those states passed initiatives last month to legalize recreational use of marijuana. As of last Thursday, it's legal under Washington law for anyone 21 and over to possess up to 1 ounce of marijuana, 16 ounces of "solid marijuana-infused product" (in other words, a pound of pot brownies) or 72 ounces of "marijuana-infused liquid."

In Colorado, Gov. John Hickenlooper signed Amendment 64 to the state Constitution on Monday, legalizing not only recreational use but also home growing, unlike in Washington.

Entrepreneurs are already planning stores to get more buck for the bhang.

"Part of the mission of our company is to transform marijuana from a back-alley drug being sold by criminals into a premium product being enjoyed by responsible adults," said Jamen Shively, chief executive of Diego Pellicer Inc., a new company that hopes to open a chain of stores in Washington and Colorado as soon as the legal issues are cleared up.

The company is named for Shively's great-grandfather, who grew hemp in the Philippines. It eventually became the biggest hemp supplier in the world around the turn of the 20th century. ("It's a family business," said Alan Valdes, a veteran securities trader who recently joined the company as chairman.)

"We're creating the category of premium marijuana," said Shively, who worked as a corporate strategy manager for Microsoft Corp. from 2003 to 2009 before leaving for a specialty food startup. "If you are producing or intending to produce premium-grade product that's in line with our ethos, we're interested in talking to you."

Americans to feds: Keep your hands off our pot

But Diego Pellicer and its customers may be in for a long wait.

The federal government still insists that marijuana is a Schedule I controlled substance and that buying and selling it for any purpose remains a federal crime. Federal authorities officially even frown on the pot that patients get at medical marijuana dispensaries, although their policy is to look the other way in those cases.

For recreational users, well, "you're a felon," said Mark A.R. Kleiman, editor of the Journal of Drug Policy Analysis. "Period. End of paragraph."

And so is your retailer.

"Regardless of any changes in state law ... growing, selling or possessing any amount of marijuana remains illegal under federal law," said Jenny Durkan, the U.S. attorney in Seattle. She said the Justice Department is reviewing its options in Washington and Colorado.

Buzzkill: Feds fire warning shot over pot legalization

Shively said that under no circumstances would his company violate federal law.

"Let's suppose tomorrow that Washington state issued licenses and said, 'Go ahead, guys, have at it.' We would say to the state of Washington respectfully, 'Thanks, but no thanks, because we haven't heard from the federal government.'"

Until then, Diego Pellicer is rounding up funding and private shareholders to be ready if and when the Justice Department changes course.

"I think it's going to be hard for the Obama administration to slap this down," Valdes said. "Washington is a liberal Democratic state that helped (President Barack Obama) get elected. The people voted for him ? it would be a slap in the face."

Dan Satterberg, the prosecuting attorney in King County, Wash., which is home to a thriving marijuana scene in and around Seattle, thinks the Justice Department will try anyway.

The Washington and Colorado laws require state agencies to facilitate something the federal government considers an illegal act ? the sale and distribution of marijuana. That raises an important states' rights question that only the courts can sort out, he said.

Satterberg told NBC station KING of Seattle that he expects the states and the Justice Department to wind up before the U.S. Supreme Court within the next couple of years to argue the issue.

KING: Clearing up the new marijuana law: What's legal?

Overlooked in the immediate reaction to passage of the initiatives, both pro and con, is an important public health question, said Kleiman, who is a professor of public policy at the University of California-Los Angeles and co-author of "Drugs and Drug Policy: What Everyone Needs to Know."

It's not the question you might expect ? how much does legalization increase marijuana use? ? but "how much does legalization increase abuse?" he told NBC News.

Assuming marijuana use follows the pattern of alcohol use, most of the marijuana consumed in the U.S. is used by the 20 percent minority of people who abuse it, he said. Most pot users use it now for light recreational purposes, but if it's legal, how big will that 20 percent grow?

"Nobody knows," he said.

Questions like that are why it might, in fact, be wise for the federal government to step back and let Washington and Colorado serve as laboratories, so policy makers can "find out what happens."

If it does, Shively and Valdes will be ready.

"We are building our entire business on the premise it will be sufficiently legal in the next few months or a year," Shively said ? a business that will include merchandising beyond simple sales of premium pot.

Rare fossil related to crabs, lobsters, shrimp: Exceptionally well preserved, including shell and soft parts

Dec. 12, 2012 ? An international team of researchers have made an extremely rare discovery of a species of animal -- related to crabs, lobsters and shrimps -- that is new to science.

Scientists from the universities of Leicester, Oxford, Imperial and Yale have announced their discovery of a new and scientifically important fossil species of ostracod in the journal Proceedings of The Royal Society B. The research was funded by the Natural Environment Research Council.

The discovered species, which is up to 10 millimetres long, is special because it is exceptionally well preserved, complete with not only the shell but also the soft parts -- its body, limbs, eyes, gills and alimentary system. Such discoveries are extremely rare in the fossil record.

The discovery of the tiny shelled arthropod was made in 425 million year old rocks in Herefordshire, Welsh Borderland. The rocks at the site date to the Silurian period of geological time, when southern Britain was a sea area on a small continent situated in warm, southerly subtropical latitudes. The ostracods and associated marine animals living there were covered by a fall of volcanic ash that preserved them frozen in time.

Professor David Siveter, of the University of Leicester Department of Geology, said: "The two ostracod specimens discovered represent a genus and species new to science, named Pauline avibella. The genus is named in honour of a special person and avibella means 'beautiful bird', so-named because of the fancied resemblance of a prominent feature of the shell to the wing of a bird."

"Ostracods are the most abundant fossil arthropods, occurring ubiquitously as bivalved shells in rocks of the last 490 million years, and are common in most water environments today. The find is important because it is one of only a handful preserving the fossilised soft-tissues of ostracods. Its assignment to a particular group of ostracods based on knowledge of its biology is at odds with its shell form, thus urging caution in interpreting the classification of fossil ostracods based on shell characters alone."

"The preservation of soft-parts of animals is a very rare occurrence in the fossil record and allows unparalleled insight into the ancient biology, community structure and evolution of animals -- key facts that that would otherwise be lost to science. The fossils known from the Herefordshire site show soft-part preservation and are of global importance."

The fossils were reconstructed 'virtually', by using a technique that involves grinding each specimen down, layer by layer, and photographing it at each stage. Ten millimetres is relatively tiny, but at an incremental level of 20 ?m (micrometres) that yields 500 slices, which can then be pieced together in a computer to provide a full, three-dimensional image of each fossil, outside and in.

Professor Siveter added: "Fossil discoveries in general help elucidate our own place in the tree of life. This discovery adds another piece of knowledge in the jigsaw of understanding the diversity and evolution of animals."

"It is exciting to discover that a common group of fossils that we thought we knew a lot about may well have been hood-winking us as to their true identity, which we now realise because we have their beautifully fossilised soft-parts. A case of a 'wolf in sheep's clothing'."

The research was undertaken together with Professor Derek Siveter and Dr Sarah Joomun (Oxford), Dr Mark Sutton (Imperial College London) and Professor Derek Briggs (Yale, USA).

Note: The genus is named in honour of Pauline Siveter, in memoriam, late wife of the lead author of the paper.

Consumers seek to punish fellow consumers who violate social norms while shopping but also make exceptions depending on the situation, according to a new study in the Journal of Consumer Research.

"Punishment is a complex decision for consumers to make as it is difficult to punish someone but also difficult to look the other way. Consumers do not seem to make these decisions lightly, and a number of interesting factors influence consumer punishment decisions," write authors Lily Lin, Darren W. Dahl (both University of British Columbia), and Jennifer J. Argo (University of Alberta).

Consumers are expected to follow numerous social norms while shopping. Yet violations of these norms are also very common. For example, some consumers may cut in front of others while waiting in line for a cashier at the supermarket, while others may take multiple free samples when they aren't supposed to or create a huge mess at a store display. How do consumers respond when other shoppers "break the rules" in their presence?

One study revealed that consumers were less likely to punish another consumer for creating a mess if they had already been punished by a store employee. Other studies showed that consumers were also less likely to punish a fellow consumer for cutting in line if that person had experienced adversity due to a situation (a computer glitch during airport check-in) or a negative physical attribute beyond their personal control (obesity due to a medical condition).

Another interesting study showed that consumers were less likely to want to punish a fellow consumer who was late for an appointment if this individual had higher status. In this instance, the consumer in the higher status position was held to a different standard and excused for their bad behavior.

"We all have frequent interactions with other consumers in shopping environments and can attest to times when other shoppers haven't behaved properly. Companies need to be aware of how this could negatively affect their business since these types of conflicts can affect how consumers make decisions and evaluate their shopping experience," the authors conclude.

This is a short video and for those who do not know this group the Military Religious Freedom Foundation is dedicated to protecting the constitutional rights of all of the men and women of our military services. Over 30,000 aggrieved MRFF clients have testified to the grim nature of the deluded Taliban-esque environment some have imposed, or sought to impose, on our servicemembers. By means of mandatory prayer ceremonies, fundamentalist indoctrination masquerading as training materials, and an environment that ostracizes all but the most zealous Evangelical Christians (among other foul methods of coercive proselytization), these forces have treacherously misused and abused all four major service branches as incubators for raising "God's Army" - to borrow their own perverse and twisted phrase.

Clarke, Ret. back in 2002 that anyone who joined the military was stupid and had best die on the battlefield. War for the most part today is fought in the boardrooms and courts. Armed combat only comes into play when resources such as those in Darfur and other places are threatened by foreign powers such as the PRC or markets such as those in the Arab world remained closed to them and maximum short term profits. <br/> Religion is a great way to control people. I have read a couple articles about this Evangelical Chiliasm manifesting its ugly head among the US forces. I believe that Fort Jackson [correct me if I'm wrong about the base] has a Christian training and retreat camp which all recruits are exhorted to join and convert. It really helps with advancement if you do. I've also read reports of religious discrimination in the field and combat zones too. This is the "religious" paradigm espoused and supported by Bush and Blair; both of whom are practicing Luciferians and use Christianity as a front. If there were viable jobs and education costs weren't through the roof; would intelligent young people be joining the military as they have done today? While no one should not extrapolate this out to all chaplains in the military, it is a real problem. As a <br/>W W 2 Gasoline Tanker Mariner, I was an atheist before I entered the service and unsurprised that most of my shipmates shared my lack of religiosity. It was mandatory that the Skipper held a "Church" service on Sunday in the "Smoke Room". I honestly cannot ever remember any crew member attending. Oh there were some with religious affiliation but none who would ever admit to it. That is the big difference between most of the advanced nations citizens, and those of American nationality. We in Australia, generally, would never bring up, in conversation, our religious preference as it would be considered bad manners, indeed it is illegal to pose that question on an employment application.
